  17. 1. By installing the software, you indicate your acceptance of the terms and
  18.    conditions of the agreement between Nemetschek AG, the licensor, and
  19.    you, the licensee. Nemetschek AG hereby grants you the non-exclusive
  20.    right to use the acquired software on the terms set forth below.
  21.    Any rights beyond this scope remain the sole property of the licensor.

  23. 2. As licensee, you are entitled to make a backup or archival copy
  24.    of the original media on which the software is supplied or you may
  25.    install the software on any single computer provided the original media
  26.    or backup copies are used solely for archival purposes. Furthermore,
  27.    you are entitled to use the software on a computer i.e. to load it into
  28.    the computer's memory for the purposes of data entry, processing and
  29.    output. You are also entitled to make copies of the software inasmuch
  30.    as this is part of regular data backup procedures.
  31.    You may not reproduce the software or parts thereof. You may not re-
  32.    produce the printed documentation or parts thereof. Transfer of the
  33.    software or the printed documentation to individuals outside your
  34.    company or organiztion is subject to the terms set forth in paragraph
  35.    5. In particular, you may only transfer the software and printed docu-
  36.    mentation on a permanent basis provided you retain no copies of the
  37.    software or printed documentation.

  39. 3. You may use the software on a single computer. Use of the software
  40.    on more than one computer requires the prior written consent of the
  41.    licensor. Making copies of the software for use on multiple computers
  42.    without the prior written consent of the licensor is expressly forbidden.

  44. 4. You may not modify or create derivative works based on the software
  45.    or portions thereof. You may not remove company names, trademarks,
  46.    copyright notices or information designed to protect the software
  47.    ownership rights.

  49. 5. You may transfer your right to use the software, together with the
  50.    original media and the original printed documentation to another
  51.    person on a permanent basis provided you retain no copies of
  52.    the software (including archival copies) and delete the software from
  53.    all media. The transfer may only be to a single individual and must
  54.    include all the software on all the computers. Furthermore, you just
  55.    inform the licensor of the transfer and name the successor in writing.
  56.    Transfer of license only becomes applicable for the licensor after
  57.    receipt of the written  tranfer notice.

  59. 6. You hereby agree to respect the terms and conditions set forth above. 
  60.    You also agree to treat the software and printed documentation 
  61.    confidentially and to take all reasonable precautionary measures
  62.    to prevent the software or printed documentation from being repro-
  63.    duced or taken by a third party. You agree that by acting in a 
  64.    manner that is contrary to any of the terms of this agreement makes
  65.    you liable to a charge equivalent to five times the license fee
  66.    for the software in question.

  68. 7. This agreement covers only the right to use software you have
  69.    acquired. Warranty, workmapship and liability issues are
  70.    covered in the terms and conditions of Nemetschek AG.

  77. NOTES ON DATA BACKUP
  78.  
  79.    Prior to installing PlanDesign FT, please check that you
  80.    have made a full backup set of all your data and that the backup
  81.    copy can be restored.
  82.    You should back up your data at regular intervals to eliminate
  83.    the risk of data loss due to theft, fire, disk failure etc.

  85.    Our setup routines have been developed with the utmost care
  86.    and are subjected to intensive testing.
